La RCP protège le professionnel de santé en cas d'erreur qui a un impact sur un patient. Pour que la garantie fonctionne, le patient doit prouver la faute pendant un soin. Un accident peut arriver au cabinet, au domicile ou en EHPAD, et la garantie peut prendre en charge l'indemnisation. Depuis la loi Kouchner, il faut souscrire une assurance pour les libéraux et la présenter lors de l'inscription au tableau de l'Ordre.

La RCP a pour rôle de vous protéger en cas de manquement ayant un impact sur le patient. (The RCP’s role is to protect you in the event of a breach that has an impact on the patient.)
Pour engager la RCP, c'est au patient lésé de prouver la faute commise lors d'un acte de prévention, de diagnostic ou de soins. (To trigger the RCP, it is up to the injured patient to prove the fault committed during an act of prevention, diagnosis or care.)
Cette responsabilité peut être engagée au cabinet, au domicile du patient ou lors d'une mission en EHPAD. (This liability may be engaged at the practice, at the patient’s home, or during an assignment in a nursing home (EHPAD).)
Par exemple, si une patiente chute de la table de soins et se fracture le bassin. (For example, if a patient falls from the treatment table and fractures her pelvis.)
Une condamnation pour défaut de surveillance peut alors être prononcée. (A conviction for lack of supervision may then be issued.)
L'indemnisation de la patiente est prise en charge par la garantie RCP. (Compensation of the patient is covered by the RCP guarantee.)
Elle couvre le préjudice physique, moral et financier subi par le patient. (It covers the physical, moral and financial harm suffered by the patient.)
Depuis la loi Kouchner de deux mille deux, la RCP est obligatoire pour les professionnels de santé libéraux. (Since the Kouchner law of two thousand and two, RCP has been mandatory for self-employed healthcare professionals.)
Elle est exigée lors de l'inscription au tableau de l'Ordre et fortement conseillée en milieu hospitalier. (It is required when registering on the Order’s roll and is strongly recommended in the hospital setting.)
En cas de litige, la RCP intervient pour une solution amiable ou pour prendre en charge les frais de défense et d'indemnisation. (In the event of a dispute, the RCP steps in for an amicable solution or to cover the costs of defense and compensation.)
