Quando si firma un contratto di affitto, l’inquilino paga una cauzione. (When signing a rental agreement, the tenant pays a security deposit.)
La cauzione serve per pagare eventuali danni all’appartamento. (The security deposit is used to cover any damage to the apartment.)
L’inquilino paga solo i danni fatti per incuria o colpa, non quelli del normale uso della casa. (The tenant only pays for damage caused by negligence or fault, not for normal wear and tear.)
Il proprietario non può decidere da solo il valore dei danni e non può dire semplicemente: «Mi tengo la cauzione». (The owner cannot decide the amount of the damages alone and cannot simply say, “I’ll keep the deposit.”)
Se il proprietario vuole trattenere la cauzione, deve fare causa all’inquilino e il giudice decide il valore dei danni. (If the owner wants to withhold the deposit, they must sue the tenant and a judge decides the amount of the damages.)
Se il proprietario non restituisce la cauzione e non fa causa, allora l’inquilino può fare causa al proprietario per chiedere la restituzione della cauzione. (If the owner does not return the deposit and does not sue, the tenant can sue the owner to recover the deposit.)
